Terms of Use

These terms are an agreement between you and Entrainements Mindflex S.E.N.C. (NEQ 3380232473), [MAILING ADDRESS], Quebec, Canada ("Mindflex", "we", "us"). They apply when you use the Mindflex app. By creating an account or continuing to use Mindflex, you agree to them and to our Privacy Policy. If you do not agree, do not use the app.

Your health comes first. Mindflex offers general fitness and mental-training guidance, not medical advice. Talk to a doctor before starting any exercise program, especially if you are pregnant, injured or have a health condition. Stop right away if you feel pain, dizziness or shortness of breath, and get medical help if you need it.

1. Who can use Mindflex

You must be at least 18 years old and live in Canada or the United States. You must give us accurate information and keep it up to date.

2. Your account

You sign in with your email (we send you a one-time code or link) or with Apple or Google. Keep access to that email and those accounts secure: anyone who can read your email or use them can sign in to your Mindflex account. Tell us right away at support@mindflex.fitness if you think someone else has accessed your account. One account is for one person.

3. Membership, free trial and billing

  • Mindflex membership is a subscription, billed monthly or yearly through the Apple App Store or Google Play. The price, taxes and currency are shown in the store before you buy.
  • New members may be offered a 7-day free trial. Unless you cancel before the trial ends, your paid membership starts when it ends and is charged by the store. Whether you are eligible for a trial is decided by the store.
  • Your membership renews automatically for the same period until you cancel. You can cancel at any time in your App Store or Google Play subscription settings; cancelling stops the next renewal, and you keep access until the end of the period already paid.
  • Payments and refunds are handled by Apple or Google under their rules. Deleting the app or your Mindflex account does not cancel a store subscription.
  • If we change the price, the store will tell you before it applies, and you can cancel before the new price takes effect.

4. Using Mindflex content

Our programs, workouts, Mind sessions, videos, audio, text and designs belong to Mindflex or its licensors. While your account is in good standing we give you a personal, non-transferable licence to use them in the app for your own non-commercial use. You may download sessions to use offline; downloads stay inside the app, and the app needs to go online from time to time to keep them available. Downloaded content stops being available if your membership ends.

5. What you agree not to do

  • copy, record, share, resell or publicly show Mindflex content;
  • share your account or try to access someone else's;
  • reverse engineer, scrape, overload or interfere with the app or our systems, or get around its security or access controls;
  • use Mindflex for anything illegal, harmful or abusive, including toward our team.

6. Changes to the app

We improve Mindflex regularly and may add, change or remove programs and features. If a change significantly reduces what your paid membership includes, we will tell you in advance, and you can cancel.

7. Suspension and closing your account

You can stop using Mindflex and ask us to delete your account at any time. We may suspend or close an account that seriously or repeatedly breaks these terms, or when the law requires it. Where possible we will tell you why first and give you a chance to fix the problem.

8. Our responsibility

We work hard to keep Mindflex available and accurate, but we cannot promise that it will always be uninterrupted, error-free or suited to your particular needs. You choose how hard to train and are responsible for exercising safely within your own limits.

To the extent the law allows, Mindflex is not responsible for indirect losses, and our total responsibility to you for any claim is limited to the amount you paid for your membership in the 12 months before the claim. Nothing in these terms limits or excludes responsibility for bodily or moral injury caused to you, for intentional or gross fault, or any other responsibility that cannot be limited by law.

9. Your rights as a consumer

Nothing in these terms takes away rights you have under the Quebec Consumer Protection Act or the consumer protection laws of the province or state where you live. If a part of these terms is not allowed where you live, it does not apply to you, and the rest still applies.

10. Changes to these terms

We may update these terms. We will post the new version here with a new effective date and, if the change is significant, tell you in the app or by email at least 30 days before it applies, explaining what changes. You can refuse the change by cancelling your membership and closing your account before it applies.

11. Governing law

These terms are governed by the laws of Quebec and the federal laws of Canada that apply there. If you live outside Quebec, you also keep the protections of the mandatory laws where you live, and you may bring a claim in the courts of your place of residence.

12. Language

These terms are available in French and English. Les présentes conditions sont offertes en français et en anglais.
